We may update service descriptions and pricing from time to time on our website. The version in place at the time of your booking will apply to your project.
2. Prices, VAT, Payments, and Billing
2.1 Currency
All prices for our services are listed in GBP (£) and are payable in GBP.
2.2 VAT Status
We are currently not registered for VAT in the United Kingdom. No VAT is charged on our services, and all prices shown are final unless expressly stated otherwise.
2.3 Secure Online Checkout & Merchant Accounts
Full payment is required at the time of purchase. Payments are processed securely through our integrated online checkout powered by third-party processors (such as Stripe or Squarespace Payments).
We do not store or collect your payment card details directly on our servers.
Your booking is not confirmed until payment has been successfully cleared and you receive a written order confirmation email from us.
2.4 Transactional Disclaimers
We are not liable for any payment processing failures, card declines, or transaction errors caused by third-party payment gateways, bank blocks, or Stripe system downtimes.
2.5 Out-of-Scope and Additional Work
Where any additional services are agreed upon after the original booking (for example, extra design concepts, additional rooms, extra 3D views, or additional revisions beyond what is included in the purchased package), these will be quoted and invoiced separately as a custom project. All such invoices must be paid in full before we commence the extra work.
3. Client Responsibilities and Measurements
3.1 Data Provision
For all digital and remote services, you are fully responsible for providing accurate and complete information, including but not limited to:
Room dimensions, wall lengths, and ceiling heights.
Locations and sizes of doors, windows, radiators, electrical sockets, and fixed features.
Photographs and/or videos of the existing space showing all angles.
Any relevant architectural details, structural restrictions, or special styling considerations.
3.2 No Verification
We rely entirely on the information, dimensions, and media you provide and cannot independently verify your measurements or physical site conditions.
3.3 Critical Liability Waiver
We cannot be held liable or legally responsible for any furniture fitment issues, spatial layout errors, structural mismatches, delivery failures, or return shipping fees resulting from inaccurate, outdated, or incomplete information provided by you.
3.4 Buying Responsibility
You are solely responsible for re-checking and verifying all final measurements, dimensions, and site constraints (including doorways and stairwells) before placing orders for any products from third-party retailers listed in your curated shopping list.
4. Booking, Cancellations, and Our Right to Cancel
4.1 Design Questionnaire & Concept (£99.00)
4.1.1 This is a purely digital, advisory service delivered by email. After purchase, you will be sent a link to complete our design questionnaire and upload photos of your space.
4.1.2 If you wish to cancel, you must contact us before you submit your completed questionnaire and before we have started reviewing your project. If we confirm that no design work has started, we may issue a refund, less any reasonable administrative and transaction processing costs.
4.1.3 Once we have begun reviewing your questionnaire and preparing your recommendations, the service becomes active, bespoke, and strictly non-refundable (see Section 8).
4.2 Full Room E-Design & Furniture Curation / Premium 3D Room Design
4.2.1 These services are bespoke digital design packages. Once we have started any preparatory design work (including research, inspiration sourcing, mood boards, initial layouts, or 3D modelling), the booking becomes strictly non-refundable (see Section 8).
4.2.2 You may request to cancel before we start any work. If we confirm that no work has started, we may issue a refund, less any reasonable administrative and transaction processing costs.
4.3 Designer Right to Cancel and Reschedule
4.3.1 We reserve the right to adjust project timelines or, in rare cases, cancel a booking in circumstances such as illness, technical issues, family emergencies, or periods of exceptional workload that would prevent us from delivering the service to a professional standard. In such cases we will:
Notify you as soon as reasonably practicable; and
Offer a revised delivery schedule or, if we cancel, a full or fair pro-rata refund for any uncompleted portion of the service.
4.3.2 Any refund issued under clause 4.3.1 will be your sole and exclusive remedy in respect of such cancellation. We will not be liable for any indirect or consequential losses you may incur as a result of our rescheduling or cancellation, such as loss of opportunity, contractor delay fees, or costs associated with delayed building works.
5. Project Timelines and Expiry
5.1 Design Questionnaire & Concept
We aim to deliver your summary email within approximately 48 hours of receiving your completed questionnaire and photos. This timeframe is an estimate and may be affected by the volume of work and clarity of the information provided.
5.2 Full Room E-Design & Furniture Curation
The estimated delivery timeframe of 3–5 weeks begins only after we have received all required information from you, including completed questionnaires, accurate measurements, and photographs.
5.3 Premium 3D Room Design & Complete Styling
The estimated delivery timeframe of 4–7 weeks begins only after we have agreed on the fixed fee and received all required information from you, including completed questionnaires, accurate measurements, and photographs.
5.4 Client Delays
Any delay from you in providing the required information, approving concepts, or responding to our questions will extend the timelines. We are not responsible for delays caused by your late responses, changes of mind, or additional requests.
5.5 Project Expiry and Dormancy
5.5.1 For the Design Questionnaire & Concept service, you must submit your completed questionnaire and photos within 30 days of purchase.
5.5.2 For Full Room E-Design and Premium 3D Room Design, you must submit all required questionnaires, measurements, and photos within 60 days of purchase.
5.5.3 If we do not receive the required materials within these timeframes, your project will be marked as dormant and cancelled without a refund, as our capacity, schedule, and diary were reserved for your project. Reactivating a dormant project is subject to our availability and will require a re-booking fee and/or updated pricing.
6. Third-Party Products, Pricing, Stock, and Platform Disclaimers
6.1 Third-Party Retail Links
Our design packages include curated shopping lists with hyperlinks to products from third-party retailers across the UK for your convenience. We do not sell, manufacture, stock, or supply these products directly, and we are not a party to any sales contract between you and the third-party retailer.
6.2 No Guarantees
We do not guarantee stock availability, prices, colours, finishes, shipping times, or delivery fees of third-party products. UK retailers may change prices, discontinue products, or alter stock availability at any time, independently of LIVO Design.
6.3 No Product Liability
We are not responsible for the quality, workmanship, delivery, assembly, structural safety, or warranty of any products you purchase from third-party links. Any issues, defects, delays, or returns must be addressed directly with the third-party retailer in accordance with their terms.
6.4 Website and Digital Platform Disclaimer
We rely on third-party service providers (such as Squarespace for website hosting and e-commerce, and Google Workspace for business email hosting and cloud storage). While we endeavor to maintain a secure and functional website, we are not liable for any communication delays, technical glitches, server downtimes, data transmission failures, or temporary inability to access our services caused by these third-party platforms.
7. Architectural, Structural and Safety Disclaimer
7.1 Aesthetic and Spatial Planning Only
Our concepts, layouts, mood boards, questionnaires, recommendations, and 3D visualisations are provided for aesthetic, spatial planning, and interior styling purposes only.
7.2 No Structural Services
We do not provide architectural, structural, engineering, building, or safety regulation services. We do not advise on load-bearing walls, structural changes, plumbing re-routing, electrical rewiring, or compliance with local building regulations.
7.3 Contractor Consultations Required
Before carrying out any construction, structural changes, electrical, plumbing, or building works, you must consult appropriately qualified and licensed local professionals and obtain any required building control permissions, landlord approvals, or structural approvals. Any implementation of our styling concepts without consulting qualified professionals is done entirely at your own risk.
8. Digital Service Refund Policy and Bespoke Services
8.1 No Statutory Cooling-Off Period
Our digital design services are bespoke and personalized to you and your property. Because of this, the standard 14-day “cooling-off” cancellation period for distance contracts under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply once we have commenced work on your project, in line with UK consumer law exceptions for custom-made and bespoke services.
8.2 Non-Refundable Process
Due to the highly bespoke and digital nature of our services, payments become strictly non-refundable once we have commenced the design process. This includes any time spent on research, inspiration sourcing, questionnaire review, mood boards, concept sketches, spatial layouts, written recommendations, or 3D modelling.
8.3 Waiver of Change-of-Mind Rights
By purchasing any of our digital design services, you acknowledge that you waive any standard “change of mind” cancellation rights after we begin work, because the service is customized exclusively for you and cannot be reused, recycled, or resold to another client.
8.4 Discretionary Adjustments
In exceptional circumstances, and at our sole discretion, we may agree to provide a partial refund or credit, but we are under no legal obligation to do so once the design process has started.
9. Right to Refuse Service and Termination
9.1 Refusal and Termination Criteria
We reserve the right, at our sole discretion, to refuse any booking or terminate an ongoing project where a client:
Is consistently uncooperative, non-responsive, or fails to provide the necessary materials for over 60 days.
Uses abusive, threatening, discriminatory, hostile, or otherwise inappropriate language or behaviour toward LIVO Design.
Fails to comply with these Terms and Conditions.
9.2 Pro-Rata Refunds
If we terminate a project due to such behaviour after work has started, we will assess the work completed and may, at our absolute discretion, issue a pro-rata refund for any clearly identifiable uncompleted phases. Work already delivered, researched, or substantially completed will not be refunded.
9.3 Access Restriction
We may also restrict or block your access to our website, client portals, and official communication channels where necessary to protect our business, assets, and staff.
10. Standard of Service and No Guarantee of Outcome
10.1 Care and Skill
We will exercise reasonable skill and care in providing our services in line with professional interior design practice, as required by UK consumer law for service contracts.
10.2 Subjectivity of Design
Interior design is inherently subjective. While we will make every effort to interpret your preferences, questionnaires, and brief, we cannot guarantee that our designs will meet your personal taste in every respect or that they will increase the resale value of your property.
10.3 Statutory Remedies
If we fail to provide our services with reasonable care and skill, you may be entitled under UK consumer law to request that we repeat or fix the service within a reasonable time and without significant inconvenience. Where repeat performance is impossible or cannot be provided within a reasonable time, you may be entitled to a price reduction in line with your statutory rights.
10.4 Client Autonomy
Any decisions you make to purchase products, hire contractors, carry out building works, or implement our styling suggestions are your sole responsibility.
11. Use of Project Images and Portfolio
11.1 Marketing Consent
With your permission, we may take or request photographs of your completed space and use non-identifiable “before and after” images in our portfolio, website, and social media for marketing purposes.
11.2 Privacy Safeguards
We will never publish your full address, personal contact details, or any other identifying information, keeping your privacy completely secure.
11.3 Opt-Out
If you do not wish your project images to be used in this way, you must inform us in writing before the end of the project. We will always respect your decision.
12. Complaints and Dispute Resolution
12.1 Contact Us First
If you are unhappy with any aspect of our service, please contact us in the first instance at hello@livodesign.co.uk so we can try to resolve the issue informally, quickly, and professionally.
12.2 Good-Faith Negotiations
Both parties agree to make reasonable, good-faith efforts to resolve any dispute through discussions and negotiations before considering any legal action.
13. Force Majeure
13.1 Delay Exceptions
We will not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is caused by events beyond our reasonable control, including but not limited to illness, strikes, lock-outs, accidents, acts of God, war, natural disasters, failure of telecommunications or internet services, or actions of government authorities.
13.2 Alternative Arrangements
Where a force majeure event occurs, we will notify you as soon as reasonably practicable and will work with you to find a suitable alternative timescale or solution.
14. Limitation of Liability
14.1 Financial Cap
To the maximum extent permitted by UK law, our total aggregate liability to you, whether in contract, tort (including negligence) or otherwise arising out of or in connection with our services, is strictly limited to the total amount you paid to us for the specific service package giving rise to the claim.
14.2 No Consequential Loss
We are not liable for any indirect, consequential, or special losses, including but not limited to loss of profit, loss of revenue, loss of opportunity, loss of enjoyment, or any costs associated with construction works, hired trades, or purchases that you choose to undertake.
14.3 Statutory Exceptions
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be limited or excluded under English law.
15. Intellectual Property
15.1 Our Property
All custom design concepts, mood boards, questionnaires, written recommendations, 2D layouts, 3D renderings, and any other creative materials produced by us remain our sole intellectual property.
15.2 Client License
We grant you a non-exclusive, non-transferable licence to use these materials solely for your own personal, non-commercial use in relation to the specific residential property specified in your project.
15.3 Distribution Restrictions
You must not resell, redistribute, copy, or use our designs for commercial marketing, or apply them to multiple properties without our prior written consent.
16. Governing Law and Jurisdiction
16.1 England & Wales Law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed strictly by the laws of England and Wales.
16.2 Cardiff Courts
The courts of England and Wales shall have exclusive jurisdiction to settle any disputes arising out of or relating to these Terms or our services. As we are based in Cardiff, any legal proceedings must be brought exclusively in the courts serving Cardiff, United Kingdom.
17. Entire Agreement, Changes and Severability
17.1 Entire Agreement
These Terms, together with any written proposal, booking confirmation, checkout policies, or service description on our website at the time of purchase, constitute the entire agreement between us and you and supersede any prior discussions, emails, or understandings relating to the services.
17.2 Policy Updates
We may update these Terms from time to time. The latest version will always be published on our website. Your continued use of our services after any changes will indicate your acceptance of the updated Terms.
17.3 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of law, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
18. Governing Language and Translation Discrepancies
This Agreement and our Privacy Policy are negotiated and executed in the English language. In the event that this website is translated into any other language (including the Welsh language) for your convenience, the English language version shall remain the sole, governing, and authoritative text for all purposes of contract interpretation, compliance, and legal enforcement. In the case of any discrepancy, conflict, or ambiguity between the original English text and any translated version, the provisions of the English version shall strictly prevail
